This website is operated by Hemptowns LLC. Throughout the site, the terms “we”, “us” and “our” refer to Hemptowns LLC. By accessing our website or purchasing from us, you agree to be bound by these Terms & Conditions, including all policies referenced herein, including our Shipping Policy and Refund & Return Policy.

If you do not agree to these Terms, you may not access the website or purchase products.

We reserve the right to update or modify these Terms at any time. Continued use of the website constitutes acceptance of any changes.

Online Store Eligibility

By using this site, you represent that:

  • You are at least 21 years of age (or the legal age required in your jurisdiction to purchase hemp-derived products).

  • You are legally permitted to purchase hemp-derived products in your state or jurisdiction.

  • You will not use our products for any unlawful purpose.

We reserve the right to refuse service to anyone at any time.

Product Compliance & Legal Responsibility

Hemptowns LLC sells hemp-derived products in compliance with applicable federal law, including the 2018 Farm Bill.

However, laws vary by state and locality. It is solely the customer’s responsibility to understand and comply with all applicable local, state, and federal laws before purchasing.

By purchasing, you acknowledge that:

  • You are legally permitted to receive these products.

  • You assume all responsibility for lawful possession and use.

  • You release Hemptowns LLC from liability arising from unlawful use or possession.

Shipping & Risk of Loss

All products are shipped pursuant to a shipment contract.

Risk of loss and title pass to the customer upon transfer of the product to the carrier.

Once the carrier marks an order as “Delivered” to the address provided at checkout, the order is considered fulfilled.

Carrier delivery confirmation constitutes proof of fulfillment.

Hemptowns LLC is not responsible for:

  • Carrier delays

  • Lost or stolen packages after delivery confirmation

  • Delivery errors not confirmed in writing by the carrier

Customer Responsibility for Shipping Information

Customers are solely responsible for providing accurate and complete shipping information at checkout.

We ship orders strictly to the address entered and confirmed by the customer.

We are not responsible for:

  • Incorrect addresses

  • Incomplete addresses

  • Auto-filled or outdated saved addresses

Orders delivered to the address provided at checkout are considered properly fulfilled and are not eligible for refund.

Refund & Return Policy Acknowledgment

By placing an order, you acknowledge and agree to our Refund & Return Policy and Shipping Policy.

All sales are subject to those policies.

Refunds will not be issued for:

  • Orders marked as Delivered

  • Incorrect addresses entered by the customer

  • Opened or used consumable products

  • Sale or wholesale items

All refund decisions are made at our sole discretion.

Order Acceptance & Fraud Prevention

We reserve the right to refuse or cancel any order at our sole discretion.

We may limit quantities per person, household, or address.

We reserve the right to cancel orders suspected of:

  • Fraud

  • Chargeback abuse

  • Resale activity without authorization

Chargebacks & Payment Disputes

By placing an order, you agree to contact us directly before initiating a chargeback or payment dispute.

We reserve the right to submit the following as evidence in response to disputes:

  • Order confirmation

  • Checkout confirmation

  • IP address logs

  • Payment authorization

  • Shipping confirmation

  • Carrier delivery confirmation

Fraudulent disputes may result in permanent account restriction and potential legal action.

Disclaimer of Warranties

All products and services are provided “as is” and “as available” without warranties of any kind, express or implied.

We do not guarantee uninterrupted or error-free service.

We do not warrant that products will meet individual expectations.

Limitation of Liability

To the fullest extent permitted by law, Hemptowns LLC shall not be liable for:

  • Indirect or consequential damages

  • Loss of profits

  • Loss of revenue

  • Loss of data

  • Damages arising from misuse of products

Our maximum liability shall not exceed the amount paid for the product purchased.

Arbitration & Venue

Any dispute arising from use of this website or purchase of products shall be resolved exclusively through binding arbitration in Broward County, Florida.

You waive the right to participate in any class action lawsuit.

All disputes shall be governed by the laws of the State of Florida.

Indemnification

You agree to indemnify and hold harmless Hemptowns LLC and its affiliates from any claims, damages, losses, liabilities, or legal fees arising from:

  • Violation of these Terms

  • Unlawful use of products

  • Breach of applicable laws

Severability

If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, along with our Shipping Policy, Refund Policy, and Privacy Policy, constitute the entire agreement between you and Hemptowns LLC.
